Istotne jest, \u017ce zgodnie z kodeksem pracy pracownik w \u017caden spos\u00f3b nie mo\u017ce zrzec si\u0119 prawa do urlopu.&nbsp;<\/p>\n\n\n\n<div class=\"separator mt-8 mb-8\"><span class=\"separator__line\"><\/span><\/div>\n\n\n\n<h3 id=\"wymiar\" class=\"heading h-24\"><strong>Wymiar urlopu<\/strong>&nbsp;<\/h3>\n\n\n\n<p>Pracownikowi przys\u0142uguje prawo do corocznego, nieprzerwanego p\u0142atnego urlopu wypoczynkowego.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Wymiar urlopu wynosi:&nbsp;<\/p>\n\n\n\n<ul class=\"list\">\n<li class=\"list-item\"><span class=\"text\">20 dni &#8211; je\u017celi pracownik jest zatrudniony kr\u00f3cej ni\u017c 10 lat;<\/span><\/li>\n\n\n\n<li class=\"list-item\"><span class=\"text\">26 dni &#8211; je\u017celi pracownik jest zatrudniony co najmniej 10 lat.<\/span><\/li>\n<\/ul>\n\n\n\n<p class=\"text\">Do okresu zatrudnienia, od kt\u00f3rego zale\u017cy prawo do urlopu i wymiar urlopu, wlicza si\u0119 okresy poprzedniego zatrudnienia, bez wzgl\u0119du na przerwy w zatrudnieniu oraz spos\u00f3b ustania stosunku pracy.&nbsp;<\/p>\n\n\n\n<p class=\"text\">Do okresu pracy, od kt\u00f3rego zale\u017cy wymiar urlopu, wlicza si\u0119 tak\u017ce okresy nauki. Zgodnie z kodeksem pracy z tytu\u0142u uko\u0144czenia:&nbsp;<\/p>\n\n\n\n<ul class=\"list\">\n<li class=\"list-item\"><span class=\"text\">zasadniczej lub innej r\u00f3wnorz\u0119dnej szko\u0142y zawodowej &#8211; przewidziany programem nauczania czas trwania nauki, nie wi\u0119cej jednak ni\u017c 3 lata,\u00a0<\/span><\/li>\n\n\n\n<li class=\"list-item\"><span class=\"text\">\u015bredniej szko\u0142y zawodowej &#8211; przewidziany programem nauczania czas trwania nauki, nie wi\u0119cej jednak ni\u017c 5 lat,\u00a0<\/span><\/li>\n\n\n\n<li class=\"list-item\"><span class=\"text\">\u015bredniej szko\u0142y zawodowej dla absolwent\u00f3w zasadniczych (r\u00f3wnorz\u0119dnych) szk\u00f3\u0142 zawodowych &#8211; 5 lat,\u00a0<\/span><\/li>\n\n\n\n<li class=\"list-item\"><span class=\"text\">\u015bredniej szko\u0142y og\u00f3lnokszta\u0142c\u0105cej &#8211; 4 lata,\u00a0\u00a0<\/span><\/li>\n\n\n\n<li class=\"list-item\"><span class=\"text\">szko\u0142y policealnej &#8211; 6 lat,\u00a0\u00a0\u00a0<\/span><\/li>\n\n\n\n<li class=\"list-item\"><span class=\"text\">szko\u0142y wy\u017cszej &#8211; 8 lat.\u00a0\u00a0\u00a0<\/span><\/li>\n<\/ul>\n\n\n\n<p class=\"text\">Je\u017celi pracownik pobiera\u0142 nauk\u0119 w czasie zatrudnienia, do okresu pracy, od kt\u00f3rego zale\u017cy wymiar urlopu, wlicza si\u0119 b\u0105d\u017a okres zatrudnienia, w kt\u00f3rym by\u0142a pobierana nauka, b\u0105d\u017a okres nauki, zale\u017cnie od tego, co jest korzystniejsze dla pracownika.&nbsp;<\/p>\n\n\n\n<p>Pracownik podejmuj\u0105cy prac\u0119 po raz pierwszy, w roku kalendarzowym, w kt\u00f3rym podj\u0105\u0142 prac\u0119, uzyskuje prawo do urlopu z up\u0142ywem ka\u017cdego miesi\u0105ca pracy, w wymiarze 1\/12 wymiaru urlopu przys\u0142uguj\u0105cego mu po przepracowaniu roku.&nbsp;<\/p>\n\n\n\n<p>Prawo do kolejnych urlop\u00f3w pracownik nabywa w ka\u017cdym nast\u0119pnym roku kalendarzowym.&nbsp;<\/p>\n\n\n\n<div class=\"separator mt-48 mb-32\"><span class=\"separator__line\"><\/span><\/div>\n\n\n\n<h3 id=\"obowiazek\" class=\"heading h-24\"><strong>Obowi\u0105zek udzielenia urlopu<\/strong>&nbsp;<\/h3>\n\n\n\n<p>Obowi\u0105zkiem pracodawcy jest udzielenie pracownikowi urlopu w tym roku kalendarzowym, w kt\u00f3rym pracownik uzyska\u0142 do niego prawo. Urlop jest udzielany przez pracodawc\u0119, co oznacza, \u017ce bez jego zgody pracownik nie mo\u017ce skorzysta\u0107 z urlopu wypoczynkowego.&nbsp;<\/p>\n\n\n\n<p>Urlop wypoczynkowy jest udzielany w konkretnych dniach. Na wniosek pracownika urlop mo\u017ce by\u0107 podzielony na cz\u0119\u015bci. W takim jednak przypadku co najmniej jedna cz\u0119\u015b\u0107 wypoczynku powinna trwa\u0107 nie mniej ni\u017c 14 kolejnych dni kalendarzowych.&nbsp;<\/p>\n\n\n\n<p>Zasad\u0105 jest, \u017ce urlopy powinny by\u0107 udzielane zgodnie z planem urlop\u00f3w. Ustala go pracodawca, bior\u0105c pod uwag\u0119 wnioski pracownik\u00f3w i konieczno\u015b\u0107 zapewnienia normalnego toku pracy. Planem urlop\u00f3w nie obejmuje si\u0119 cz\u0119\u015bci urlopu na \u017c\u0105danie. W tym przypadku \u017c\u0105danie udzielenia urlopu pracownik zg\u0142asza najp\u00f3\u017aniej w dniu rozpocz\u0119cia urlopu.&nbsp;<\/p>\n\n\n\n<p>Pracodawca nie ustala planu urlop\u00f3w, je\u017celi zak\u0142adowa organizacja zwi\u0105zkowa wyrazi\u0142a na to zgod\u0119; dotyczy to tak\u017ce pracodawcy, u kt\u00f3rego nie dzia\u0142a zak\u0142adowa organizacja zwi\u0105zkowa. W takich przypadkach pracodawca ustala termin urlopu po porozumieniu z pracownikiem.&nbsp;&nbsp;<\/p>\n\n\n\n<div class=\"separator mt-48 mb-32\"><span class=\"separator__line\"><\/span><\/div>\n\n\n\n<h3 id=\"forma\" class=\"heading h-24\"><strong>Forma wniosku urlopowego<\/strong>&nbsp;<\/h3>\n\n\n\n<p>\u017baden przepis kodeksu pracy i rozporz\u0105dzenia o dokumentacji pracowniczej nie wymaga sporz\u0105dzania kart urlopowych ani sk\u0142adania wniosk\u00f3w urlopowych w formie pisemnej.&nbsp;<\/p>\n\n\n\n<p>Analizuj\u0105c przepisy, nale\u017cy zauwa\u017cy\u0107 \u017ce ustawodawca nie na\u0142o\u017cy\u0142 na pracodawc\u0119 obowi\u0105zku sporz\u0105dzania dokumentacji urlopowej w formie papierowej. Tym samym pracodawca mo\u017ce dopu\u015bci\u0107 elektroniczn\u0105 form\u0119 sk\u0142adania wniosk\u00f3w urlopowych.<\/p>\n\n\n\n<div class=\"separator mt-48 mb-32\"><span class=\"separator__line\"><\/span><\/div>\n\n\n\n<h3 id=\"termin\" class=\"heading h-24\"><strong>Ostateczny termin udzielenia urlopu<\/strong>&nbsp;<\/h3>\n\n\n\n<p>Urlopu niewykorzystanego w terminie ustalonym zgodnie planem urlop\u00f3w nale\u017cy pracownikowi udzieli\u0107 najp\u00f3\u017aniej do dnia 30 wrze\u015bnia nast\u0119pnego roku kalendarzowego.&nbsp;<\/p>\n\n\n\n<p>W okresie wypowiedzenia umowy o prac\u0119 pracownik jest obowi\u0105zany wykorzysta\u0107 przys\u0142uguj\u0105cy mu urlop, je\u017celi w tym okresie pracodawca udzieli mu urlopu.&nbsp;&nbsp;<\/p>\n\n\n\n<div class=\"separator mt-48 mb-32\"><span class=\"separator__line\"><\/span><\/div>\n\n\n\n<h3 id=\"wynagr\" class=\"heading h-24\"><strong>Wynagrodzenie za czas urlopu wypoczynkowego<\/strong>&nbsp;&nbsp;<\/h3>\n\n\n\n<p>Za czas urlopu pracownikowi przys\u0142uguje wynagrodzenie, jakie by otrzyma\u0142, gdyby w tym czasie pracowa\u0142. Zmienne sk\u0142adniki wynagrodzenia mog\u0105 by\u0107 obliczane na podstawie przeci\u0119tnego wynagrodzenia z okresu 3 miesi\u0119cy poprzedzaj\u0105cych miesi\u0105c rozpocz\u0119cia urlopu; w przypadkach znacznego wahania wysoko\u015bci wynagrodzenia okres ten mo\u017ce by\u0107 przed\u0142u\u017cony do 12 miesi\u0119cy.&nbsp;<\/p>\n\n\n\n<div class=\"separator mt-48 mb-32\"><span class=\"separator__line\"><\/span><\/div>\n\n\n\n<h3 id=\"ekwiwal\" class=\"heading h-24\"><strong>Ekwiwalent za urlop<\/strong>&nbsp;<\/h3>\n\n\n\n<p>W przypadku niewykorzystania przys\u0142uguj\u0105cego urlopu w ca\u0142o\u015bci lub w cz\u0119\u015bci z powodu rozwi\u0105zania lub wyga\u015bni\u0119cia stosunku pracy pracownikowi przys\u0142uguje ekwiwalent pieni\u0119\u017cny.&nbsp;<\/p>\n\n\n\n<p>Pracodawca nie ma obowi\u0105zku wyp\u0142acenia ekwiwalentu pieni\u0119\u017cnego, w przypadku gdy strony postanowi\u0105 o wykorzystaniu urlopu w czasie pozostawania pracownika w stosunku pracy na podstawie kolejnej umowy o prac\u0119 zawartej z tym samym pracodawc\u0105 bezpo\u015brednio po rozwi\u0105zaniu lub wyga\u015bni\u0119ciu poprzedniej umowy o prac\u0119 z tym pracodawc\u0105.&nbsp;<\/p>\n\n\n\n<div class=\"separator mt-48 mb-32\"><span class=\"separator__line\"><\/span><\/div>\n\n\n\n<h3 id=\"macierz\" class=\"heading h-24\"><strong>Urlop po urlopie macierzy\u0144skim&nbsp;<\/strong><\/h3>\n\n\n\n<p>Zgodnie z kodeksem pracy na wniosek pracownicy pracodawca udziela jej urlopu wypoczynkowego bezpo\u015brednio po urlopie macierzy\u0144skim. Dotyczy to tak\u017ce ojca wychowuj\u0105cego dziecko lub innego cz\u0142onka najbli\u017cszej rodziny, kt\u00f3ry korzysta z urlopu macierzy\u0144skiego.&nbsp;&nbsp;<\/p>\n\n\n\n<p>W takim przypadku udzielenie urlopu jest bezwzgl\u0119dnym obowi\u0105zkiem pracodawcy. Pracodawca w takiej sytuacji nie ma mo\u017cliwo\u015bci odmowy udzielenia urlopu pracownikowi, kt\u00f3ry wraca do pracy, po zako\u0144czonym urlopie zwi\u0105zanym z rodzicielstwem.&nbsp;<\/p>\n\n\n\n<div class=\"separator mt-56 mb-32\"><span class=\"separator__line\"><\/span><\/div>\n\n\n\n<div class=\"post-meta\">\n\t<div
